These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and Denis Svichkarev ("we", "us", or "our") regarding your access to and use of the IncVocab mobile application and website at https://incvocab.netlify.app/ (collectively, the "Service").

License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use IncVocab for personal, non-commercial purposes. This license does not include any rights to:

• Modify, distribute, or create derivative works
• Reverse engineer or attempt to extract source code
• Use the Service for commercial purposes without authorization
• Remove or alter any proprietary notices

User Conduct and Prohibited Activities

You agree to use the Service responsibly and in compliance with all applicable laws. You are prohibited from:

• Uploading, sharing, or distributing unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, or otherwise objectionable content
• Engaging in harassment, discrimination, or intimidation based on race, gender, religion, sexual orientation, age, disability, or other protected characteristics
• Infringing on intellectual property rights of any party
• Distributing spam, chain letters, or unauthorized advertising
• Introducing viruses, malware, or other harmful code
• Impersonating any person or entity, including our representatives
• Attempting to gain unauthorized access to our systems or other users' accounts
• Using automated tools or scripts to access the Service

Enforcement: We reserve the right to terminate your access immediately for violations of these Terms, without prior notice and without liability to you.

Intellectual Property Rights

All content, features, and functionality of IncVocab, including but not limited to text, graphics, logos, icons, images, audio clips, and software, are the exclusive property of IncVocab and are protected by international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of any content from our Service without explicit written permission.

User-Generated Content

Any content you create within the app (such as custom vocabulary collections) remains your property. However, by using our Service, you grant us a non-exclusive license to use, store, and process this content solely for the purpose of providing the Service.

Third-Party Services and Links

Our Service may contain links to third-party websites or integrate with third-party services. We are not responsible for the content, privacy practices, or terms of use of these external services. Your interactions with third parties are solely between you and the third party.

Disclaimers and Limitation of Liability

We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Accuracy or reliability of content

Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of the Service.

Our total liability shall not exceed the total amount you have paid to us in the 12 months preceding the claim.

You agree to defend, indemnify, and hold harmless IncVocab, its affiliates, officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from:

• Your use of the Service

• Your violation of any third-party rights
• Any content you submit or transmit through the Service

Termination

Either party may terminate this agreement at any time. We may terminate or suspend your access immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason in our sole discretion.

Upon termination, your right to use the Service will cease immediately. All provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in accordance with Italian arbitration rules, except where prohibited by law. You retain the right to bring claims in small claims court if they qualify.

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and IncVocab regarding the Service and supersede all prior agreements and understandings.

Assignment

We may assign our rights and obligations under these Terms without restriction. You may not assign your rights or obligations under these Terms without our prior written consent.

Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, or government actions.
